WARRANTY
Seieffe Corporation, located at Northwoods Industrial Park, 12227K FM 529, Houston TX, 77041 (hereafter called ‘Seieffe’) warrants to the original owner of the interior worktop or decorative OKITE® quartz surface, that Seieffe will, for a period of ten (10) years after the date of installation, at its discretion, replace or repair, without charge, the OKITE® quartz surface installed by a Seieffe approved installer, if the OKITE® quartz surface fails due to any defect in the structural integrity of the product during the manufacturing process and not due to the fabrication process. The general terms and conditions of this ten (10) year limited warranty are as follows:01) This warranty applies exclusively to interior decorative OKITE® quartz surfaces that are installed by Seieffe™ approved installers and in accordance with installation procedures.
02) This warranty does not cover any damage(s) caused by any:
- improper or inadequate use, care or maintenance;
- material modification or misuse;
- outdoor use;
- physical, chemical or mechanical abuse;
- exposure to excessive heat (e.g. direct heat);
- non-use of hot pads;
- damage due to improper installation procedures;
- thermal shock;
- improper site preparation or site maintenance;
- improper use described in the OKITE® Use & Care Instructions;
- act of God;
- use as floor ing material;
- failure to pay for the product;
- failure to register within ten (10) days after the date of installation; or
- failure to allow Seieffe to inspect the alleged defective product.
03) This ten (10) year limited warranty coverage is further limited to reimbursement of the following amounts dur ing the following periods after the date of installation: years 1 to 4 after installation, in case of Seieffe ’s responsibility, 100% of original material cost will be covered; years 5 and 6 after installation , in case of Seieffe’s responsibility, 75% of original material cost will be covered; years 7 and 8 after installation , in case of Seieffe’s responsibility, 50% of original material cost will be covere d; and years 9 and 10 after installation, in case of Seieffe’s responsibility, 25% of original mater ial cost will be covered.
04) To receive coverage under this ten (10) year limited warranty, proof of purchase in the form of the duly completed warranty card shall be submitted with the claim (no proof - no coverage) within ten ( 10) days from the date of installation.
05) This warranty is transferable within the ten (10) year warranty period ONLY when the new owner writes to Seieffe (for address please refer to paragraph 13) to register the warranty under ne w owner’s name. The OKITE® Use & Care instructions is available upon request.
06) Any OKITE quartz surface replacement or repair needs to be authorized in writing by Seieffe.
07) This warranty applies only for interior installations of OKITE® quartz surfaces completed:
- After May 1, 2003 in the United States of America; and
- Installations which have not been moved from their original place of interior installation; and for
- Installations by a duly authorized, OKITE® approved installer; and for
- Installations which are maintained according to the OKITE® Use & Care Instructions.
A free OKITE Use & Care Instructions may be obtained from your duly authorized, OKITE® installer or by writing to Seieffe (for address please refer to paragraph 13, below).
08) If Seieffe is unable to replace or repair a defective product which is covered by this warranty, Seieffe shall , within a reasonable time after being notified of the defect, refund the purchase price of the OK ITE® quartz surface in the amount described in paragraph 3, above, provided the owner hands over the defective OKITE® quartz surface to Seieffe or its appointed representative.
09) Neither Seieffe nor any third party make any other warranty of any kind, whether express or implied, with respect to OKITE® quartz surfaces. Seieffe and its third party suppliers specifically disclaim the implied warranties of merchantability and fitness for a particular purpose other than interior worktop or decorative surfaces use.
10) Seieffe shall not be liable in either tort or contract for any loss or direct, consequential or incidental damages arising out of the use or inability to use OKITE® quartz surfaces in interior worktop or decorative surface installations.
11) Except for the obligations specifically set forth in this warranty, in no event shall Seieffe be liable for any dire ct, indirect, special, incidental, or consequential damages, whether based on contract, tort, or any other legal theory and whether advised of the possibility of such damages.
12) To the extent the Uniform Commercial Code of the state in which the OKITE quartz surface was installed contradicts this warranty the terms of the Uniform Commercial Code of the State in which the OK ITE quartz surface was installed shall govern.
13) This ten (10) year limited warranty coverage for OKITE® quartz surfaces is your ultimate assurance of lasting quality . If we can answer any further questions regarding this warranty, please contact:

14) This ten (10) year limited warranty is governed by Texas law. The courts of Houston, Texas shall have exclusive jurisdiction over any dispute arising out or in connection with this limited warranty, including any question regarding its interpretation or its execution
